An important corrigendum: my interpretation of the anti-spam article 13 of the Privacy and Electronic Commerce Directive (2002/58/EC) missed an important loophole. Fortunately Masons solicitors (who gave a talk on the 15th of May on Spam, the Law and On-line marketing) didn't. It will be illegal to send spam to subscribers, but not to other users. This means that you must personally have a contract with a publicly available electronic communications service provider; being a user at a site which has such a contract isn't enough. In simpler terms, randomvictim@iol.ie is protected, but randomvictim@work.ie isn't.
